Each ticket (package) that you purchase is a license to attend a particular event, and is subject to the additional terms set forth on that particular ticket by the issuer. It is the buyer's responsibility to find, read and agree to those additional terms set forth by the issuer of the ticket. If you have any questions about the information below, please contact us. These, "Purchase Terms and Conditions" supersede any other Terms Of Service on the website and are the only terms which will be used to determine the policies of buying tickets or packages from Atnight.com.
Facebook Connect and other Social Media Applications
Atnight.com provides their viewers the opportunity to use helpful Facebook features through an API called Facebook Connect. Users, after accepting to install the Atnight.com application, will be able to interact with friends and share some of the actions or content featured on Atnight.com through their profiles on Facebook. By accepting to install the application, you permit Atnight.com to access your Facebook profile information, as well as any of the other requirements requested by Atnight.com, and granted by you, when using the application. Atnight.com operates in accordance with the Facebook terms of use and this Privacy Statement. Once you install the Atnight.com application and connect with Facebook, you will be able to automatically post recent Atnight.com activity back to your Facebook wall, tag photos, inform friends and show viewers of Atnight.com comments you made, or plans to attend an event. Please refer to the privacy settings in your Facebook account to manage the performance of your Facebook account.
Permitted Currency
All ticket prices for events that take place in the United States are stated in U.S. Dollars and no other currency is accepted. Yes, not even Euros! Accepted Payment Methods: Atnight.com only accepts Paypal transactions as payment for the herein mentioned transactions. Currently we accept American Express, Visa, MasterCard, Discover, Diner's Club and any other form accepted by Paypal as payment. No cash transactions or any other form of payment is accepted by atnight.com.
Who Are You Buying the Tickets From
The tickets you are purchasing are not property of, nor belong to Atnight.com. Atnight.com is acting as a mediator to those who are organizing, promoting or otherwise responsible for making the event happen, which you are purchasing tickets for. The owner of an event might be a venue, promotional team, an artist or representatives, clubs, promoters and/or leagues (collectively referred to as "event providers").
When you purchase a ticket through Atnight.com, you will be purchasing that ticket from the Event Provider, not Atnight.com. Please be sure to make note of this. We do not make decisions for the event. Ticket Pricing and Availability: Do to high demand or popularity of the event or Atnight.com.
Event tickets may sell out quickly. Atnight.com does not control the inventory or the availability and schedule to release additional tickets. There may be times when after an event has been sold out, the event provider may make available additional tickets prior to the event. In the case where this happens, the event provider might grant Atnight.com, or other distribution channels, additional subsequent allocations of tickets for sale. Those tickets may have a different price point than the original offering. Those tickets may arguably be of similar or higher desirability than those previously sold on Atnight.com. The rates offered may be subject to change due to availability and demand. Atnight.com reserves the right to change ticket pricing at any time without notice and/or of the convenience service charge. The tickets may be offered for sale at lower prices on other websites other than on Atnight.com and vice versa.
You have to Confirm your Order
Every ticket purchase made on Atnight.com must be accompanied by a confirmation number to be deemed valid. If you purchase tickets or packages through our site and you do not receive a confirmation number after submitting your payment information, or if you experience an error message or some sort of service interruption after submitting your payment information, it is your responsibility to confirm with atnight.com Customer Service whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process and you need to communicate to us to find your confirmation number (confirmations are made through a page or by email). Atnight.com will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation if you do not contact us. No exceptions.
Fees, Convenience Charges and Order Processing Rates
Any tickets purchased on Atnight.com will typically be subject to a per ticket convenience charge and a non-refundable per order processing fee. In many cases, delivery prices may also apply. Each fee, charge and rate may differ depending on event rates and demand. The "service charge" may vary from ticket to ticket.
Ticket Limits - The Max Amount of Tickets Per Customer
Due to high demand and limited inventory, when purchasing tickets on atnight.com, you are limited to a maximum number of tickets for each event available for purchase. This limit is posted during the purchase process and is verified with every transaction. You are not allowed to buy more than the max number of tickets permitted on the site. Failing to comply with this policy may result in cancelation of your transaction and further actions on our behalf to deter you from this actions, including but not limited to legal action. You cannot Re-Sell your Tickets: From time to time, we believe we come up with what we think are great ideas. Reselling your tickets is not one of them. Reselling the tickets you have purchased on Atnight.com is an unlawful practice that can get you into serious trouble. Even the simple attempt to resell your tickets is grounds for confiscation and cancellation without compensation. No ticket can be used for any personal gain or benefit. You cannot advertise, promote, raffle or otherwise use the tickets for any commercial use unless the event provider gives formal written authorization prior to your actions. Now, even is the event provider grants you or your company such authorization, any use of Atnight.com's trademarks and other intellectual property must be cleared through Atnight.com. This means we will have to give you written authorization to use our trademark and or any intellectual property prior to you benefiting or using it.
What to do if an Event is Canceled and Postponed
Unfortunately, from time to time, the events we are marketing and selling tickets for, are canceled by the event provider. If we ever have the unfortunate occurrence of this situation, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed event, please check the event information on our site and on the event provides website for the latest event details. If you purchase a ticket through Atnight.com and a refund is warranted, then Atnight.com will most likely give you a refund by issuing a credit to the credit card that you used to purchase that ticket. No cash refunds are allowed.
Atnight.com does not offer refunds and/or exchanges for any tickets or packages sold for any of the events featured on the site and is not obligated to issue a refund under any circumstance. The decision about whether or not to issue a refund or an exchange is exclusively up to the event providers discretion, not Atnight.com. However, if the event provider responsible for bringing you the event (1) instructs us to issue a refund, and (2) provides us with the ticket funds necessary to issue refunds, Atnight.com may choose to offer the buyers a refund/credit for their purchase. The buyer must comply with the event providers' instructions and/or deadlines to qualify for the refund or an exchange being offered.
If Atnight.com issues you a refund for a ticket, it will issue a refund of the ticket's face value paid (any discounted ticket, then instead the discounted ticket price paid will be refunded). All other fees, including but not limited to convenience fees, delivery fees, or any other fees or amounts charged are not refundable. When a refund is issued, it will be issued using the same method of payment that was originally used to purchase the tickets. No exceptions allowed. If a credit card was used to make the original purchase, then only that particular credit card will receive the credit for the refund. When purchasing any tickets, coupons, packages or any services or items from Atnight.com, you agree not to hold Atnight.com and any employees, affiliates, advertisers, agencies or other individuals or corporations associated with Atnight.com, liable for travel or any other related expenses and losses that you or anyone else incurs in connection with a canceled or postponed event.
If an event is postponed or canceled for any reason, please contact us for information on receiving a refund. If the event was moved or rescheduled, the event provider may set particular refund restrictions, which you must be aware of to properly receive your credit. Please contact us prior to contacting your credit card and requesting a charge back. When contacting us, make sure to include your account number so we can process your refund if applicable.
Do you want a Refund or Exchange Your Ticket
Stop! Before you purchase any tickets or any packages from Atnight.com, please be sure to carefully review the event description, the ticket information, terms, seating options and any other items that may apply to the event and the ticket or package you are purchasing, because all of our SALES ARE FINAL. This will help you assure you are satisfied with your purchase and to avoid any surprises. The policies for the events and the tickets and packages sold to access them are set forth by the event providers, not Atnight.com, and they generally prohibit us from changing their terms and policies. This includes offering refunds or exchanges to any ticket sold on our site. If your ticket was lost, stolen, damaged, destroyed or is simply no longer useful, we cannot replace it, refund it or in any other way compensate you for the loss. You hereby agree that you will not attempt to evade, avoid, or circumvent these prohibitions in any manner with regard to tickets or packages you purchased from Atnight.com. Without limiting the generality of the foregoing, you will not contact Atnight.com to seek a refund or exchange from Atnight.com when Atnight.com is prohibited from providing one by its clients, and you will not dispute or otherwise seek a "chargeback" from the company whose credit card you used to purchase tickets from the Site. Should you do so, your tickets may be canceled, and Atnight.com may, in its sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site. Again, we do NOT provide refunds to any ticket purchase, however, in the rare and exceptional case where venues do authorize refund requests (for cancelled or over sold events), you will be granted the amount of your purchase, but may be subject to service, devilery, or other fees. Gaining unathorized access to an event (including, but not limited to, bribing, sneaking into events, and impersonatation), failure to confirm your ticket with an event provider, or any kind of reproduction or fabricaiton of tickets in order to gain entry will immeadiately disqualify any refund request.
Performances (including DJs)
When a ticket is for a concert, or live performance, the event provider may have an opening act or special guest presenters that may sometimes performer prior to the headliners. Atnight.com may not be made aware by the event provider of any opening acts or the length of their performances. This may change the time of the headliners event and performance. The performers may be subject to change at any time without notice on most cases so please be sure to check with the event provider for opening act information, headliners terms in case of any changes. No refund will be owed if an act is changed or canceled unless it's specified by the event provider.
Choosing a Delivery Option
When purchasing your tickets, please be sure to carefully review the list of options available for delivery or pickup. These options may carry additional fees and may not always be available to you. They may be different combinations of delivery offered to you. The one that best suits you will depend on several factors, including the date of the event, the venue, the demand for tickets to the event, the country where the event is being held, the country where you reside, how long it may take to deliver the tickets to you via courier, whether it's a holiday season, the event providers options and many other possible factors. Not all tickets have all delivery options.
The following delivery options may be offered to you and may be subject to additional fees or restrictions. When you are purchasing a ticket, please review them carefully and see which one best suits your needs. All mailing options must have a physical ticket provided by the Event Provider in order to be shipped. If the event only has paperless tickets or it is a package deal, all tickets will be picked up at a will call window at the venue hosting the event on the night of the event.
Will Call - This option is for events that occur in the USA
Standard USPS Mail - This option is for events that occur in the USA. However, we usually ask for at least a 10 day prior to the event shipping day window for this option. For this option, you must have a valid USA billing and shipping address.
UPS and FedEx - The event must take place on the USA, but only for purchasers who use a United States billing address and allows enough time for shipping the tickets within the USA (typically 7 days).
Paperless Ticket - In the case of these tickets, usually a unique confirmation code will be provided to the purchaser to present at the venue the night of the event. This is only an option for events that take place in the USA. You must present your valid ID and the credit card used to purchase the tickets on Atnight.com.
Pricing and Other Errors
Atnight.com will have the right to cancel your ticket purchase (or the order for that ticket) and refund to you the amount that you paid if; (a) you paid an amount for a ticket that is incorrect regardless of whether because of an error in the posted price on Atnight.com or otherwise communicated to you, or (b) because you were able to order a ticket before its scheduled on-sale or presale date or (c) you were able to order a ticket that was not supposed to have been released for sale. This term will apply regardless of whether because of a transactional malfunction of Atnight.com other another website or operated system human. No exceptions.
Verifying your Billing Information
In order to properly process your ticket order, you must provide us with the correct billing information. This information must be verified to properly confirm your order. From time to time, a user may enter the incorrect billing or credit card account information for a ticket order. This will cause your order to be voided and you will not receive your tickets. In these cases, please verify your billing address with your bank and/or credit card issuing company before making another purchase attempt on Atnight.com. Please, always double-check your information prior to submitting it to avoid any issues with your ticket purchase.
Use One Browser and One Window
We suggest that you use only 1 browser when purchasing your tickets on Atnight.com. Doing so will help you ensure that you are placing the order with the right information and in a timely manner. A session can timeout causing you to loose the tickets you have in your shopping cart. We are not responsible if you timeout from any sessions. So be prompt with your time. Remember that numerous other people want to buy the very same ticket you are trying to purchase, so don't waste time.
Limitation of Liability
You hereby understand and agree to assume all risks incidental to the event for which a ticket is purchased, whether before, during or after the event, and you waive any claims for personal injury, damages or death against Atnight.com, its employees, advertisers, clients and agents, on behalf of yourself, anyone else using the tickets you purchased and any accompanying minors.
Ejection and Cancellation; No Recovery Value; Ticket License
All tickets sold on Atnight.com are a revocable license and admission may be refused upon redemption of the ticket's face value. No ticket is redeemable for cash. The event providers reserve the right to refuse entry or to eject, without refund for the amount paid, to any individual whose conduct is deemed inappropriate, who uses obscene or offensive language, or who fails to comply with event provider conduct rules. Breach of these terms or rules will terminate your license to attend the event without the possibility of a refund.
Recording, Broadcasts of any Performance or Event
You hereby agree not to, or aid in any recording or transmitting, any description, account, picture, or reproduction of the event which you purchased your ticket to and are attending. You understand and concur that the event for which you purchased tickets is a public event. Your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your activities or behavior at the event. You grant permission to Atnight.com and the Event Provider(s) to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of the time, whether it was before, during or after the event took place) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
Subject to Search
Some event providers may request to search your person or your belongings prior to entering the event or perhaps even after you already entered. By buying this ticket and choosing to redeem it you hereby grant the event provider permission to search you (pat you down, use a metal detector, and other forms of searching individuals) or search through your belongings (like your purse, bags, backpacks, etc.). You also agree to waive the right to any related claims that may arise. If you elect not to grant permission to such searches, the event provider may deny your entry to the event without refund or other compensation. Certain venues, clubs, arenas or other places hosting events may have particular rules and guidelines on what can be brought in to their venues. Such items, but not limited to, guns, drugs, alcohol, cameras, recording devices, containers, pornography, or other types of paraphernalia may not be allowed at most venues.
